1. Acceptance of Terms

Welcome to ThatDailyDeal's Lifetime Commission Affiliate Program ("Program"). These Terms and Conditions ("Terms") govern your participation as an affiliate partner in our in-house affiliate program, including all commission payments, referral tracking, and partnership obligations.

Ownership and Payment Structure: ThatDailyDeal is owned and operated by Jammin' Butter LLC, a Limited Liability Company established in Nevada and operating from Tennessee. All affiliate commission payments will be made by Jammin' Butter LLC (the parent company) through Gusto, Inc. as 1099 payments. Affiliates will be onboarded into Gusto by a ThatDailyDeal representative and will need to supply the payment service Gusto, Inc. with bank account information in order to receive payments. All payments will be paid via Automatic Clearing House (ACH).

By applying to, accessing, or participating in the Program, you accept and agree to be bound by these Terms. If you do not agree to these Terms, please do not apply or participate in the Program.

ThatDailyDeal and Jammin' Butter LLC (collectively "TDD" or "we") may revise these Terms at any time. Your continued participation in the Program after such revisions constitutes acceptance of the updated Terms. We will notify affiliates of material changes via email.

2. Program Overview

2.1 Lifetime Commission Structure

The ThatDailyDeal Affiliate Program offers lifetime commission payments to approved affiliate partners. Once you successfully refer a customer to ThatDailyDeal through your unique affiliate link or tracking method, you will earn commissions on that customer's purchases for the lifetime of that customer relationship, subject to the terms outlined herein.

2.2 How It Works

You promote ThatDailyDeal products through your approved sales channels using your unique affiliate tracking links
When a customer makes their first purchase through your referral link, they are attributed to your affiliate account
You earn commissions on that customer's initial purchase and all subsequent purchases made by that customer for as long as they remain an active ThatDailyDeal customer
Commissions are calculated based on the tiered structure outlined in Section 4

2.3 Long-Term Partnership with Activity Requirements

This Program is designed as a long-term partnership. Affiliates who comply with these Terms and maintain good standing will continue to earn lifetime commissions on their referred customers. We are committed to building mutually beneficial, enduring relationships with our affiliate partners.

However, affiliates must remain actively engaged in the Program. Activity requirements are outlined in Section 4.6 to ensure meaningful, ongoing participation in the partnership.

3. Eligibility and Application

3.1 Affiliate Requirements

To participate in the Program, you must:

Be at least 18 years of age
Have the legal capacity to enter into binding agreements
Operate legitimate sales channels (website, social media, email list, etc.)
Comply with all applicable laws and regulations
Provide accurate and complete information during the application process

3.2 Application Process

All prospective affiliates must complete our application process. Upon approval, you will be required to:

Complete payment onboarding via Gusto, Inc. (facilitated by a ThatDailyDeal representative)
Provide all required tax documentation to Gusto, Inc
Submit valid bank account information to Gusto, Inc. for ACH payments
Complete verification procedures before receiving first payment

ThatDailyDeal and Jammin' Butter LLC reserve the right to approve or reject any application at our sole discretion. Approval does not guarantee continued participation if Terms are violated.

3.3 Account Information

You agree to:

Provide accurate, current, and complete information during registration
Update your information promptly to keep it accurate and current
Maintain the confidentiality of your affiliate account credentials
Notify us immediately of any unauthorized use of your account
Be responsible for all activities that occur under your account

4. Commission Structure and Payments

4.1 Tiered Commission Rates

Commissions are paid on a tiered basis according to your performance level. Commission tiers and rates will be provided to you upon acceptance into the Program and may be updated periodically at ThatDailyDeal's discretion with advance notice to affiliates.

4.2 Commission Eligibility

You will earn commissions on:

All qualifying purchases made by customers you refer
All subsequent purchases made by those customers throughout their lifetime as ThatDailyDeal customers
Only completed, non-refunded transactions

4.3 Non-Qualifying Transactions

Commissions will NOT be paid on:

Purchases made using fraudulent payment methods
Transactions that are subsequently refunded, cancelled, or charged back
Orders deemed fraudulent or in violation of our policies
Self-referral purchases (you cannot earn commissions on your own purchases)
Purchases by immediate family members or household members
Transactions identified as violating these Terms
Purchases generated through incentivized traffic or any prohibited method outlined in Section 7

4.4 Payment Terms

Payment Structure - Important: ThatDailyDeal is owned by Jammin' Butter LLC. All affiliate commission payments will be made by Jammin' Butter LLC (the parent company) through Gusto, Inc. as 1099 payments. When you receive payments, they will show as coming from Jammin' Butter LLC, not ThatDailyDeal directly. This is the standard payment structure for all affiliates.

Payment Method:All affiliate commission payments are processed via Automatic Clearing House (ACH) direct deposit through Gusto, Inc., our payroll service provider.

Onboarding Process:

A ThatDailyDeal representative will onboard you into the Gusto system
You will need to complete your Gusto profile, including providing bank account information for ACH direct deposit
You must complete all required tax forms through Gusto (W-9 for US affiliates, W-8BEN for international affiliates where applicable)
Gusto will handle all payment processing and tax form generation (1099s)

Payment Processing:

Commission payments are issued on a regular schedule as communicated to affiliates
Minimum payout thresholds apply (specified in your affiliate dashboard)
ACH payment processing typically takes 2-3 business days once initiated
Payments are deposited directly into the bank account you provide to Gusto, Inc
You are responsible for maintaining accurate and current banking information in your Gusto account
You are responsible for all applicable taxes on commission earnings

Required Documentation: To receive commission payments, you must provide to Gusto, Inc.:

Valid bank account information for ACH direct deposit
Completed tax forms (W-9 for US affiliates, W-8BEN for international affiliates, or other forms as required)
Current contact information
Any additional documentation required by Gusto, Inc. for payment processing

Payment Verification:

All banking information submitted to Gusto will be verified for legitimacy before the first payment is processed
This verification process may take 5-10 business days
Payments will not be processed until verification is complete and all required documentation is received
You will receive payment notifications through Gusto and email confirmations when payments are processed

International Affiliates: Gusto's payment capabilities may be limited for certain international locations. International affiliates should verify with their ThatDailyDeal representative during onboarding whether Gusto can process payments to their country. Alternative arrangements may be discussed on a case-by-case basis.

4.5 Currency

All commissions are calculated and paid in US Dollars (USD).

4.6 Activity Requirements and Inactivity Penalties

To maintain full commission rates and remain in good standing, affiliates must remain actively engaged in the Program.

4.6.1 Definition of Active Status

An affiliate is considered "active" when they generate qualifying sales (completed, non-refunded purchases) through their referral efforts. Clicks, impressions, or non-payable actions do NOT constitute active status—only completed sales qualify.

4.6.2 18-Month Inactivity Period

If an affiliate fails to generate any qualifying sales for a continuous period of 18 months, ThatDailyDeal and Jammin' Butter LLC reserve the right to:

Reduce the affiliate's commission rate by 50% (half of their current tier rate), OR
Remove commission eligibility entirely and terminate the affiliate relationship

The decision to reduce commissions or terminate will be made at ThatDailyDeal's sole discretion based on the circumstances and the affiliate's history with the Program.

4.6.3 Reinstatement After Inactivity

An inactive affiliate whose commissions have been reduced may be eligible for reinstatement to their original commission tier by:

Generating new qualifying sales
Demonstrating renewed active engagement in the Program
Submitting a request for reinstatement to ThatDailyDeal for review

Reinstatement is not guaranteed and is granted at ThatDailyDeal's sole discretion.

4.6.4 Payment Contact Requirements

Affiliates must maintain current, accurate contact information in both their affiliate account and Gusto profile to receive commission payments. If ThatDailyDeal or Jammin' Butter LLC attempts to contact an affiliate regarding commission payment or to verify active engagement status and:

Cannot reach the affiliate after 90 days of attempted contact through all provided contact methods, AND
The affiliate fails to respond or update their contact information

Then the affiliate will forfeit all pending commission payments and may be subject to account termination.

4.6.5 Affiliate Responsibility

It is the affiliate's sole responsibility to:

Maintain accurate and current contact information in their affiliate account and Gusto profile
Maintain current banking information in Gusto for uninterrupted payment processing
Respond to payment-related communications from ThatDailyDeal, Jammin' Butter LLC, or Gusto in a timely manner
Monitor their account activity and ensure they meet activity requirements
Generate sales activity at least once every 18 months to maintain full commission eligibility

ThatDailyDeal and Jammin' Butter LLC will make reasonable efforts to contact inactive affiliates before implementing commission reductions or forfeiture, but affiliates bear ultimate responsibility for maintaining their account and active status.

5. Customer Attribution and Tracking

5.1 Attribution Method

Customers are attributed to your affiliate account when they:

Click your unique affiliate tracking link
Complete a purchase within the designated cookie/attribution window
Have not previously been attributed to another affiliate

5.2 Last-Click Attribution

ThatDailyDeal uses a last-click attribution model. The affiliate whose link was most recently clicked before a customer makes their first purchase receives lifetime commission rights to that customer. If a customer clicks multiple affiliate links, the last affiliate link clicked within the attribution window receives the commission credit.

5.3 Attribution Window

The specific cookie duration and attribution window will be communicated in your affiliate dashboard and Program materials.

5.4 Tracking Technology

You acknowledge that commission tracking depends on cookies, tracking pixels, and other technologies. You agree not to:

Manipulate or interfere with tracking mechanisms
Use cookie stuffing or any deceptive tracking methods
Encourage customers to disable cookies or tracking
Modify or tamper with affiliate links

6. Affiliate Responsibilities and Promotional Guidelines

6.1 Approved Promotional Methods

You may promote ThatDailyDeal through:

Your legitimate websites, blogs, or online properties
Email marketing to your opt-in subscriber lists (in compliance with CAN-SPAM Act)
Social media channels you own or manage
Paid advertising (subject to approval and guidelines)
Content marketing, reviews, and comparisons
Other methods pre-approved by ThatDailyDeal in writing

6.2 Brand Representation

When promoting ThatDailyDeal, you must:

Represent our brand, products, and services accurately and honestly
Use only approved marketing materials, images, and copy
Not make false, misleading, or exaggerated claims
Clearly disclose your affiliate relationship in accordance with FTC guidelines
Not misrepresent your relationship with ThatDailyDeal or Jammin' Butter LLC (e.g., claiming to be an employee or official partner beyond the scope of this Program)

6.3 Required Disclosures

You must clearly and conspicuously disclose your affiliate relationship with ThatDailyDeal on any platform where you promote our products. Example disclosure: "This post contains affiliate links. I may earn a commission if you make a purchase through these links."

6.4 Intellectual Property

You may use ThatDailyDeal's trademarks, logos, and marketing materials only as expressly permitted
All intellectual property rights remain with ThatDailyDeal and Jammin' Butter LLC
You receive a limited, non-exclusive, revocable license to use approved materials solely for Program promotion
You may not modify ThatDailyDeal intellectual property without written permission
Product descriptions are copyrighted by ThatDailyDeal and may not be used as your own content

7. Prohibited Activities

Affiliates are strictly prohibited from:

7.1 Fraudulent Activities

Cookie stuffing, click fraud, or any form of artificial traffic generation
Self-referrals or purchasing through your own affiliate links
Encouraging or facilitating fraudulent purchases
Creating fake accounts or identities to generate commissions

7.2 Brand Bidding and PPC Restrictions

Bidding on ThatDailyDeal's trademarked terms or brand name in paid search campaigns (unless explicitly approved)
Using ThatDailyDeal's brand name in ad copy without approval
Creating misleading ads that misrepresent our products or brand

7.3 Deceptive Practices

Making false, misleading, or unsubstantiated claims about ThatDailyDeal products
Creating fake reviews or testimonials
Misrepresenting pricing, discounts, or promotions
Impersonating ThatDailyDeal, Jammin' Butter LLC, or claiming unauthorized affiliations

7.4 Incentivized Traffic

Offering cash rebates, rewards, points, or any form of incentive to customers for making purchases through your affiliate links
Promoting ThatDailyDeal through cashback sites, reward programs, or loyalty platforms without prior written approval
Providing customers with direct or indirect compensation for using your affiliate links
Any form of incentivized traffic generation that artificially inflates conversions

7.5 Unethical or Illegal Content

Promoting ThatDailyDeal on websites containing adult content, illegal content, hate speech, or discriminatory material
Associating our brand with harmful, offensive, or controversial content
Violating any applicable laws or regulations

7.6 Spam and Unsolicited Communications

Sending unsolicited emails (spam) with affiliate links
Violating the CAN-SPAM Act or other anti-spam regulations
Posting spam comments or content on forums, blogs, or social media

7.7 Trademark and Copyright Violations

Using ThatDailyDeal's or Jammin' Butter LLC's trademarks or copyrighted materials without permission
Registering domain names containing ThatDailyDeal's or Jammin' Butter LLC's trademarks
Creating social media accounts that impersonate or misrepresent ThatDailyDeal or Jammin' Butter LLC

7.8 Competitive Conflicts

Simultaneously promoting directly competing daily deal services in a manner that creates confusion
Disparaging ThatDailyDeal or our competitors
Using affiliate links on coupon or cashback sites without prior written approval

8. Termination and Suspension

8.1 Termination by ThatDailyDeal/Jammin' Butter LLC

ThatDailyDeal and Jammin' Butter LLC reserve the right to terminate or suspend your participation in the Program immediately, without prior notice, for any reason, including but not limited to:

Violation of any provision of these Terms
Fraudulent or deceptive activities
Generating invalid clicks, impressions, or transactions
Engaging in prohibited activities as outlined in Section 7
Misrepresenting ThatDailyDeal's or Jammin' Butter LLC's brand or products
Failure to maintain minimum performance standards
Inactivity for 18 months or longer without generating qualifying sales
Failure to respond to payment contact attempts within 90 days
Any conduct that damages ThatDailyDeal's or Jammin' Butter LLC's reputation or business interests

8.2 Effect of Termination

Upon termination:

Your access to the affiliate dashboard and Program materials will be revoked immediately
Your access to Gusto for payment purposes will be terminated
You must cease all promotional activities and remove affiliate links and ThatDailyDeal content from your channels
You forfeit the right to ALL commissions, both earned and unpaid, if termination is due to violation of these Terms
For non-violation terminations (mutual agreement, business reasons), unpaid earned commissions above the minimum threshold may be paid at ThatDailyDeal's and Jammin' Butter LLC's sole discretion
Your lifetime commission rights to previously referred customers will be terminated
You must return or destroy any confidential information or proprietary materials

8.3 Termination by Affiliate

You may terminate your participation in the Program at any time by providing written notice to ThatDailyDeal. Upon voluntary termination:

You must remove all affiliate links and ThatDailyDeal promotional content from your channels
You forfeit lifetime commission rights to your referred customers
Unpaid earned commissions above the minimum threshold will be paid according to the regular payment schedule through Gusto

8.4 Survival

Sections relating to confidentiality, intellectual property, indemnification, limitation of liability, and dispute resolution shall survive termination.

9. Commission Adjustments and Disputes

9.1 Right to Adjust

ThatDailyDeal and Jammin' Butter LLC reserve the right to:

Adjust or withhold commissions for transactions that are later refunded, cancelled, or charged back
Investigate and adjust commissions for suspected fraudulent or invalid transactions
Correct commission calculation errors
Withhold commissions pending investigation of Terms violations

9.2 Dispute Resolution

If you dispute a commission calculation or attribution:

You must notify ThatDailyDeal in writing within 30 days of the disputed transaction or payment
Provide detailed information supporting your claim
ThatDailyDeal will investigate and respond within a reasonable timeframe
ThatDailyDeal's and Jammin' Butter LLC's decision on commission disputes is final

10. Confidentiality

10.1 Confidential Information

As an affiliate, you may receive confidential information including:

Commission rates and tier structures
Proprietary marketing strategies
Customer data and analytics
Unreleased product information
Financial or business information

10.2 Non-Disclosure

You agree to:

Maintain strict confidentiality of all confidential information
Use confidential information solely for the purpose of participating in the Program
Not disclose confidential information to third parties without ThatDailyDeal's or Jammin' Butter LLC's written consent
Protect confidential information with the same degree of care you use for your own confidential information

11. Compliance with Laws

11.1 Legal Compliance

You agree to comply with all applicable laws, regulations, and industry standards, including but not limited to:

FTC guidelines on endorsements and testimonials
CAN-SPAM Act and anti-spam regulations
Privacy laws (COPPA, California Online Privacy Protection Act, etc.)
Intellectual property laws
Consumer protection laws
Tax reporting requirements

11.2 FTC Disclosure Requirements

You must comply with all FTC guidelines requiring disclosure of material connections. You must clearly and conspicuously disclose your affiliate relationship in all promotional content.

11.3 Privacy and Data Protection

You must:

Respect customer privacy
Not collect or misuse customer data
Comply with ThatDailyDeal's Privacy Policy
Handle any customer information in compliance with applicable privacy laws

12. Modifications to Program

12.1 Right to Modify

ThatDailyDeal and Jammin' Butter LLC reserve the right to modify the Program at any time, including:

Commission rates and tier structures
Payment terms and schedules
Eligible products or categories
Attribution methods and tracking
Program Terms and Conditions

12.2 Notice of Changes

We will provide advance notice of material changes via:

Email to your registered affiliate account email
Announcements in the affiliate dashboard
Updates to these Terms with a revised "Last Updated" date

12.3 Acceptance of Changes

Your continued participation in the Program after such modifications constitutes acceptance of the updated terms. If you do not agree with the changes, you must terminate your participation.

13. Disclaimers and Warranties

13.1 No Guarantee of Earnings

ThatDailyDeal and Jammin' Butter LLC make no guarantee regarding the amount of commissions you will earn through the Program. Your earnings depend on your promotional efforts, audience, and various market factors beyond our control.

13.2 Program Availability

The Program is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee:

Uninterrupted access to affiliate tools and tracking
Accuracy of real-time reporting
That tracking systems will be error-free
Continuation of the Program indefinitely

13.3 Product Availability

All products, pricing, and availability are subject to change without notice. ThatDailyDeal and Jammin' Butter LLC reserve the right to modify or discontinue any product without liability to affiliates.

14. Limitation of Liability

IN NO EVENT SHALL THATDAILYDEAL OR JAMMIN' BUTTER LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, COMMISSIONS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE PROGRAM, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR PARTICIPATION IN THE PROGRAM SHALL NOT EXCEED THE TOTAL COMMISSIONS PAID TO YOU IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to defend, indemnify, and hold ThatDailyDeal, Jammin' Butter LLC, their officers, directors, employees, affiliates, and partners harmless from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your violation of these Terms
Your promotional activities and content
Your violation of any law or regulation
Your violation of any third-party rights
Any claims made by customers you referred

16. Independent Contractor Relationship

16.1 No Employment

You are an independent contractor, not an employee, agent, or partner of ThatDailyDeal or Jammin' Butter LLC. This agreement does not create any employment, agency, partnership, or joint venture relationship.

16.2 No Authority

You have no authority to bind ThatDailyDeal or Jammin' Butter LLC or make commitments on our behalf. You may not represent yourself as an employee or authorized representative of ThatDailyDeal or Jammin' Butter LLC beyond the scope of this affiliate relationship.

16.3 Tax Responsibilities

As an independent contractor, you are solely responsible for:

Paying all applicable taxes on commission earnings
Providing tax documentation to Gusto, Inc. (W-9 form for US affiliates, W-8BEN for international affiliates, or other forms as required)
Accurately reporting commission income on your tax returns
Understanding that Jammin' Butter LLC will issue 1099 forms through Gusto (for US affiliates earning over $600 annually) or other required tax reporting documents
Maintaining your own business insurance and licenses if required

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Nevada, without giving effect to any principles of conflicts of law. Jammin' Butter LLC is organized as a Limited Liability Company established in Nevada and operates from Tennessee.

17.2 Arbitration

Any dispute arising out of or relating to these Terms or the Program shall be settled by binding arbitration in accordance with the American Arbitration Association rules. The arbitration shall take place in the United States, and the arbitration proceedings shall be conducted in English.

17.3 Class Action Waiver

You agree to resolve disputes with ThatDailyDeal and Jammin' Butter LLC only on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

18. General Provisions

18.1 Entire Agreement

These Terms, together with any Program materials, policies, and guidelines provided to affiliates, constitute the entire agreement between you and ThatDailyDeal/Jammin' Butter LLC concerning the Program and supersede all prior agreements or understandings.

18.2 Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

18.3 No Waiver

ThatDailyDeal's or Jammin' Butter LLC's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

18.4 Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without ThatDailyDeal's and Jammin' Butter LLC's prior written consent. ThatDailyDeal and Jammin' Butter LLC may assign these Terms without restriction.

18.5 Force Majeure

ThatDailyDeal and Jammin' Butter LLC shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or technical failures.

20. Acknowledgment

By participating in the ThatDailyDeal Lifetime Commission Affiliate Program, you acknowledge that you have read these Terms and Conditions, understand them, and agree to be bound by them. You acknowledge that:

This is a long-term partnership program with lifetime commission potential, contingent upon your continued compliance with these Terms
ThatDailyDeal is owned by Jammin' Butter LLC
Jammin' Butter LLC will make all commission payments through Gusto, Inc. via ACH direct deposit
You will receive 1099 tax forms from Jammin' Butter LLC (if applicable)
