Welcome to the ThatDailyDeal Lifetime Commission Affiliate Program ("Program"). This Privacy Policy explains how ThatDailyDeal and its parent company Jammin' Butter LLC (collectively "we," "us," or "our") collect, use, disclose, and protect the personal information of our affiliate partners ("you" or "affiliates") who participate in our Program.

Ownership and Payment Structure: ThatDailyDeal is owned and operated by Jammin' Butter LLC, a Limited Liability Company established in Nevada and operating from Tennessee. All affiliate commission payments are made by Jammin' Butter LLC through Gusto, Inc. as 1099 payments. Affiliates are onboarded into Gusto by a ThatDailyDeal representative and must supply Gusto, Inc. with bank account information to receive payments via Automatic Clearing House (ACH).

We understand the importance of your personal information and are committed to protecting your privacy. This Privacy Policy should be read in conjunction with the ThatDailyDeal Affiliate Program Terms and Conditions.

By participating in the Affiliate Program, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy.

2. Information We Collect

2.1 Information You Provide to Us

When you apply to and participate in the Affiliate Program, we collect the following types of information:

Account Registration Information:

Full legal name
Business name (if applicable)
Email address
Physical mailing address
Phone number
Date of birth (for age verification)
Website URL(s) and social media profiles
Description of promotional methods and audience

Payment Information: As part of the onboarding process, you will provide the following information directly to Gusto, Inc., our payment service provider:

Bank account information for ACH direct deposit payments
Routing and account numbers
Tax identification information (Social Security Number or Employer Identification Number)
W-9 tax form (for US affiliates) or W-8BEN (for international affiliates where applicable)
Contact information for payment verification

Note: Payment and banking information is collected and stored by Gusto, Inc., not directly on ThatDailyDeal's or Jammin' Butter LLC's servers. You will complete your payment profile through Gusto's secure platform after being onboarded by a ThatDailyDeal representative.

Communication Information:

Information contained in emails, messages, or other communications you send to us
Support ticket information and inquiries
Feedback and survey responses

2.2 Information We Collect Automatically

When you access and use the Affiliate Program dashboard and tools, we automatically collect certain information:

Technical Information:

IP address
Browser type and version
Device type and operating system
Access times and dates
Pages viewed and links clicked
Referring website addresses

Usage Data:

Affiliate dashboard activity
Click data and referral information
Conversion and sales data
Commission earnings and payment history
Login frequency and duration

We use cookies and similar tracking technologies to monitor activity in the Affiliate Program and store certain information. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your web browser (if you allow) that enables our systems to recognize your browser and capture and remember certain information.

Understand and save your preferences for future visits

Improve the Affiliate Program dashboard functionality

Gusto, Inc. (payment processing confirmation and verification)

3.4 Communication

To send you important Program updates and announcements
To notify you of commission payments and account activity
To provide customer support and respond to inquiries
To send promotional materials about new products or opportunities (with your consent)
To conduct surveys and gather feedback
To coordinate payment-related communications between you, ThatDailyDeal, and Gusto, Inc.

4. How We Share Your Information

We value your privacy and do not sell, trade, or otherwise transfer your personally identifiable information to outside parties, except as described below:

4.1 Service Providers

We may share your information with trusted third-party service providers who assist us in operating the Affiliate Program, conducting our business, or servicing you, including:

Gusto, Inc. (our payroll and payment service provider): We share necessary information with Gusto to facilitate your onboarding and payment processing. This includes your name, contact information, and the fact that you are an affiliate partner. You will provide banking and tax information directly to Gusto through their secure platform. Gusto processes all commission payments on behalf of Jammin' Butter LLC via ACH direct deposit and handles 1099 tax form generation.
Banking institutions (to process ACH direct deposits coordinated through Gusto)
Tax preparation and compliance services (to assist with 1099 form issuance through Gusto)
Email service providers (to send Program communications)
Analytics providers (to analyze Program performance)
Cloud hosting providers (to store data securely)
Fraud detection and prevention services (to verify account legitimacy)

These service providers are contractually obligated to keep your information confidential and use it only for the purposes for which we disclose it to them.

4.2 Within Our Corporate Family

Your information may be shared between ThatDailyDeal and Jammin' Butter LLC for the purposes of:

Processing and managing affiliate payments
Program administration and operations
Legal and compliance requirements
Business operations and reporting

4.3 Legal Requirements

We may disclose your information if required to do so by law or in response to:

Active Affiliates: We retain your information for the duration of your participation in the Program and for a reasonable period thereafter to process final payments and maintain records.
Inactive/Terminated Affiliates: We may retain certain information for up to seven (7) years after termination for tax, legal, and compliance purposes.
Commission and Payment Records: Jammin' Butter LLC retains commission and payment records for at least seven (7) years to comply with tax and financial regulations, including 1099 reporting requirements.
Gusto Records: Gusto, Inc. maintains its own data retention policies for payment and tax information in accordance with applicable laws.

After the applicable retention period, we will securely delete or anonymize your personal information.

6. Data Security

We implement a variety of security measures to maintain the safety of your personal information:

We do not store your complete banking information on ThatDailyDeal's or Jammin' Butter LLC's local servers. Payment information security is handled as follows:

Gusto, Inc. Security: You provide your banking and tax information directly to Gusto, Inc. through their secure platform. Gusto maintains industry-standard security measures including encryption, secure data centers, and strict access controls. Gusto is responsible for securing all payment-related information you provide to them.
Our Limited Access: ThatDailyDeal and Jammin' Butter LLC do not have direct access to your complete banking information stored in Gusto. We only receive confirmation of payment processing and necessary information for commission tracking and tax reporting.
ACH Processing: All ACH direct deposits are processed through Gusto's secure payment infrastructure, which complies with banking industry security standards and regulations.

All sensitive financial data is protected by encryption both in transit and at rest, and access is strictly limited to authorized personnel who require it to process payments and fulfill tax obligations.

6.3 Your Responsibility

You are responsible for:

Maintaining the confidentiality of your affiliate account credentials
Maintaining the security of your Gusto account credentials
Notifying us immediately if you suspect any unauthorized access to your account
Keeping your contact and banking information current in your Gusto profile

Important: While we and Gusto take reasonable measures to protect your information, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.

7. Your Rights and Choices

Depending on your location, you may have certain rights regarding your personal information:

7.1 Access and Correction

You may access and update your personal information at any time by:

Logging into your ThatDailyDeal affiliate dashboard and navigating to "My Account"
Logging into your Gusto account to update payment and tax information

You have the right to request a copy of your personal information in a structured, commonly used, and machine-readable format. For payment-related data stored in Gusto, you may need to request this information directly from Gusto.

Please note that Jammin' Butter LLC must retain certain payment and tax records for at least seven (7) years to comply with IRS and tax regulations.

Note: Even if you opt out of promotional emails, we will still send you transactional and Program-related communications (payment notifications, policy updates, tax documents, etc.).

7.5 Cookie Preferences

You can set your browser to refuse cookies or alert you when cookies are being sent. However, some features of the Affiliate Program may not function properly without cookies.

7.6 Do Not Track

Some browsers have "Do Not Track" features. At this time, we do not respond to Do Not Track signals.

8. International Data Transfers

ThatDailyDeal and Jammin' Butter LLC operate from the United States (Tennessee) and are organized under the laws of Nevada. Gusto, Inc. also operates from the United States. If you are located outside the United States and choose to participate in the Affiliate Program, your information will be transferred to and processed in the United States.

By participating in the Program, you consent to the transfer of your information to the United States and acknowledge that the United States may have different data protection laws than your country of residence.

Note for International Affiliates: Gusto's payment capabilities may be limited for certain international locations. International affiliates should verify during onboarding whether Gusto can process payments to their country

9. Children's Privacy

9.1 COPPA Compliance

The Affiliate Program is not intended for individuals under the age of 18. We do not knowingly collect personal information from anyone under 13 years of age in compliance with the Children's Online Privacy Protection Act (COPPA).

9.2 Age Verification

By participating in the Affiliate Program, you represent and warrant that you are at least 18 years of age.

9.3 Parental Notification

If we become aware that we have collected personal information from a child under 13 without parental consent, we will take steps to delete that information as quickly as possible. If you believe we have collected information from a child under 13, please contact us immediately.

10. California Privacy Rights

10.1 California Online Privacy Protection Act (CalOPPA) Compliance

Allowing users to update their information at any time through their affiliate dashboard and Gusto account
